1. General provisions

  1. These Regulations are addressed to both consumers, entrepreneurs and entrepreneurs with consumer rights who use the Online Store.
  2. The Regulations define the rules for using the services offered by the Seller and apply to all relations between the Seller and the Customer.

2. Definitions

  1. Working day - one day from Monday to Friday, excluding public holidays.
  2. Order form - an interactive form available in the Online Store enabling placing an Order, in particular by adding goods to the electronic basket and specifying the terms of the Sales Agreement, including the method of delivery and payment.
  3. Client – ​​a natural person with full legal capacity, and in cases provided for by generally applicable regulations, also a natural person with limited legal capacity; legal person; a natural person running a business; an organizational unit without legal personality, which is granted legal capacity by law; who has concluded or intends to conclude a Sales Agreement with the Seller.
  4. Consumer - a natural person concluding a contract with the Seller that is not directly related to his or her business or professional activity.
  5. Entrepreneur with consumer rights - a natural person running a business who concludes a legal transaction with the entrepreneur - a purchase - not directly related to his or her business or professional activity.
  6. Online store - a domain enabling the purchase of the Seller's Goods electronically, available at the Internet address: www.psgsklep.pl

  8. Goods – a movable item available in the Online Store that is the subject of the Sales Agreement between the Customer and the Service Provider.
  9. Sales contract - a contract for the sale of Goods concluded or concluded between the Customer and the Seller via the Online Store.
  10. User - a natural person with full legal capacity, using the Online Store website without the intention of concluding a Sales Agreement with the Seller.
  11. Order - the Customer's declaration of will submitted using the Order Form and aimed directly at concluding a Goods Sales Agreement with the Service Provider.

3. Providing services electronically

  1. Through the Store, the Seller provides electronic services to the Customer, as well as sales with delivery.
  2. The basic service provided electronically to the Customer by the Seller is to enable the Customer to place an order in the Store, leading to the conclusion of a contract with the Seller.
  3. Additionally, the Seller provides the Newsletter service to Users/Customers.
    • Receiving messages as part of the Newsletter is possible after providing: name and e-mail address and accepting consent by checking the checkbox;
    • The Customer may subscribe to the Newsletter when completing the Order Form by checking the checkbox;
    • The Newsletter service allows you to send marketing e-mails to the User/Customer free of charge, in particular regarding the Seller's offer - promotions, discount codes, new products.
    • If the Customer wishes to resign from this service or change the data, the Customer selects one of the options to cancel the Newsletter subscription or change the contact details appearing as a separate field in the footer of each e-mail message sent by the Seller as part of the said service.
  4. The User and the Customer are obliged to:
    • use the Online Store in a manner consistent with the law and good practices, taking into account the respect for the personal rights and copyrights and intellectual property of the Seller and third parties;
    • entering data consistent with the actual situation.
  5. The User and the Customer are prohibited from providing illegal content.

4. Terms of concluding a sales contract

  1. To use the Store, it is not necessary for the Customer's computer or other device to meet any specific technical conditions. Sufficient are:
    • Internet access,
    • Standard operating system,
    • Standard web browser.
  2. The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer places an Order using the Order Form in the Online Store.
  3. The use of the Order Form begins when the Customer adds the first product to the electronic basket in the Online Store. An order is placed after the Customer completes a total of two subsequent steps
  4. Filling out the Order Form. In the Order Form, the Customer must provide the following data regarding the Customer:
    • number nip
    • company name
    • first name and last name,
    • address (street, house/apartment number, postal code, city, country),
    • e-mail address,
    • contact telephone number,
  5. In addition to the data indicated above, the Customer may provide:
    • discount code;
    • a different shipping address than the address indicated in the Form;
    • comments to the order
    • bank card number, its expiry date and CVV number (if you choose to pay by card with PayU).
  6. In addition, the Customer must:
    • after completing the Order Form, the "I buy and pay" field - until then, it is possible to modify the entered data yourself (to do this, follow the displayed messages and formations available on the Online Store website)
    • indicate the form of payment from those indicated in the selection list.
    • indicate the shipping method from those indicated in the selection list,
    • The content of the concluded Sales Agreement is recorded, secured and made available to the Customer by sending an e-mail confirmation
  7. Procedure for concluding a Sales Agreement in the Online Store using the Order Form:
    • The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer places an Order in the Online Store in accordance with the provisions of the Regulations.
    • After placing the Order, the Seller immediately confirms its receipt and, after receiving payment, accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for execution is made by the Seller sending the Customer an appropriate e-mail to the Customer's e-mail address provided when placing the Order, which contains at least the Seller's declarations about the receipt of the Order and its acceptance for execution as well as confirmation of the conclusion of the Sales Agreement. When the Customer receives the above e-mail, a Sales Agreement is concluded between the Customer and the Seller.
  8. The price of the goods visible on the Online Store website is given in Polish zlotys and includes VAT. The total gross price of the goods that are the subject of the order, delivery costs and any other costs, the Customer is informed on the Online Store website when placing the Order, including when the Customer expresses the will to be bound by the Sales Agreement.
  9. The Seller reserves the right to suspend the execution of the order in a situation where the Customer has provided false data or when these data raise reasonable doubts for the Seller as to their correctness. In such a case, the Customer will be informed by phone or e-mail about the Seller's doubts. In such a situation, the Customer has the right to explain all circumstances related to verifying the accuracy of the data provided. If there is no data allowing the Seller to contact the Customer, the Seller will provide any explanations after the Customer contacts him.
  10. The Customer cannot make a purchase in the Store anonymously or under a pseudonym. The Customer must provide true personal data in the Order Form. The customer is responsible for providing false personal data.
  11. The Electronic Order Form Service is provided free of charge and is of a one-time nature and ends when the Order is placed via it or when the Customer stops placing the Order via it.
  12. making these Regulations available on the Online Store website,
  13. sending an e-mail to the Customer.
  14. The content of the Sales Agreement is additionally recorded and secured in the IT system of the Seller's Online Store.

5. Withdrawal from the contract and non-compliance of the goods with the contract

  1. The Customer who is a Consumer has the right to withdraw from the contract without giving a reason.
  2. Complaint procedure:
  3. A consumer who has concluded a distance contract may withdraw from it without giving a reason and without incurring costs within 14 calendar days from the date of taking possession of the Goods. To meet the deadline, it will be sufficient to send a declaration before its expiry.
  4. A sample withdrawal form is included in the annex to the Consumer Rights Act. The consumer may use the model withdrawal form, but this is not obligatory and does not condition the correct exercise of this right.
  5. Complaints related to the Goods or the provision of the Sales Service and Electronic Services may be submitted by the Customer or Consumer, for example:

  6. In the description of the complaint, the Customer or Consumer should provide:
    • information and circumstances regarding the subject of the complaint, in particular the type and date of occurrence of irregularities;
    • Customer/Consumer requests;
    • contact details of the complainant
  7. The Seller responds to the complaint immediately, no later than 14 calendar days from the date of its submission.
  8. If the goods are inconsistent with the contract, the Consumer has additional rights such as:
    • request for repair or replacement of the Goods,
    • request for a reduction in the price of the Goods and a refund of part of the fees paid.
    • The right to withdraw from the contract is not available if the electronically declared service has been delivered in its entirety and the Consumer has been informed before the commencement of the service that after the Seller fulfills the declaration, he will lose the right to withdraw from the contract and has acknowledged this (in particular, it applies to e-books or e-books). courses that have been transferred in full).
  9. The provisions contained in this paragraph also apply to the Entrepreneur on consumer rights, if this is provided for in separate provisions of Polish law.

6. Methods and terms of payment

  1. The Customer is obliged to make the payment immediately after accepting the final order or upon receipt of the Goods from the carrier (if cash on delivery is selected).
  2. If you choose electronic payment, the Online Store redirects the Customer to the selected payment systems.
  3. The entity providing online payment services in the field of fast transfers and payment cards is PayPro SA
  4. In addition, the Customer has the option of paying for the goods by sending a direct bank transfer to the Seller, providing the order number as the payment title. The Seller's bank account number is available in the "Contact" tab and is provided in the e-mail confirming the order.
  5. The Service Provider sends the Customer a VAT invoice to the e-mail address provided by him when placing the Order. The customer agrees to receive the invoice electronically. If the Customer wishes to receive an invoice to an address other than the provided one, he or she is obliged to indicate this via one of the available contact methods.
  6. After receiving the payment from the Customer, the Service Provider begins to provide the Service.

7. Cost, methods and date of delivery

  1. The beginning of the delivery period of the goods is counted from the date of crediting the Service Provider's bank account or settlement account and is counted in Business Days.
  2. Delivery of goods is available in Poland and abroad (only in Germany, the Czech Republic and Slovakia).
  3. Delivery of goods to the Customer is subject to payment, unless the Sales Agreement provides otherwise. The costs of delivery of goods (including fees for transport, delivery and postal services) are indicated to the Customer on the Online Store's website and when placing the Order, including when the Customer expresses his will to be bound by the Sales Agreement.
  4. Personal collection of goods by the Customer is not possible at the following address: ul. Łączyny 1, 02-820 Warsaw.
  5. The Seller provides the Customer with the following methods of delivery of goods:
    • courier shipment via Inpost or FedEX;
    • shipment made via Inpost's parcel locker service.
  6. The deadline for sending the Order to the Customer is up to 7 Business Days, unless a different deadline is specified in the description of the product or when placing the Order. In the case of goods with different delivery dates, the delivery date is the longest given date.
  7. The Seller undertakes to send the shipment on time, but is not responsible for any delays in delivery that are not due to his fault.
  8. If the Customer provides an incorrect or inaccurate address, the Seller is not liable for non-delivery or delay in delivering the subject of the service.

8. Obligations of the Seller

  1. The basis and scope of the Seller's liability towards the Customer if the sold goods have a physical or legal defect are specified in generally applicable law.
  2. The Seller is not liable for defects in the goods resulting from non-recommended use by the Customer, which is not necessary to check the correct production of the Goods.
  3. The Seller undertakes to ensure that access to the Store is uninterrupted and ensures the security of transactions carried out via the Store.
  4. The Seller is not liable for any damage suffered by the Customer as a result of malfunction of the devices with which the Customer uses the Website and Services.
  5. The Seller is not responsible for the functioning of interfaces and links that are not owned or operated by him.
  6. The Seller is not responsible for any disruptions, including interruptions, in the operation of the Store caused by force majeure or unauthorized actions of third parties. However, the Seller reserves the right to planned breaks, related, for example, to technical modifications, about which the Customer will be informed on the Store's website.
  7. The Seller undertakes to process Orders within the agreed time and to maintain good contact with the Customer through the methods specified in the Regulations.

9. Personal data in the online store

  1. The administrator of personal data processed in connection with the implementation of the provisions of these Regulations is the Seller.
  2. Each person whose personal data is processed by the Seller has the right to:
    • their individual control
    • rectifying and supplementing them
    • their removal
    • restrictions on their processing
    • their transfer
    • submit a complaint to the supervisory authority.
  3. Providing personal data is always voluntary, but in certain cases - indicated each time when using the Online Store - failure to consent to data processing may result in making it impossible to place an order.
  4. Possible recipients of personal data of Online Store Customers:
    • in the case of a Customer who uses the courier delivery method in the Online Store, the Administrator provides the Customer's collected personal data to the selected carrier or intermediary carrying out the shipment on behalf of the Administrator;
    • in the case of a Customer who uses electronic or payment card payment in the Online Store, the Administrator provides the Customer's collected personal data to the selected entity handling the above payments in the Online Store.
  5. In all matters related to the protection of personal data, the Customer may contact:

  6. Personal data are processed for the purposes, within the scope and based on the principles detailed in the Privacy Policy.

10. Out-of-court methods of handling cases and pursuing claims

  1. The Seller agrees to submit any disputes arising in connection with the concluded contracts to mediation. The details will be determined by the parties to the conflict.
  2. The consumer has the opportunity to use out-of-court methods of dealing with complaints and pursuing claims. Among other things, it has the ability to:
    • submitting a request to a permanent consumer arbitration court to resolve a dispute arising from the concluded contract,
    • Applying to the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between the Customer and the Seller,
    • using the assistance of a district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection.
  3. More detailed information on out-of-court methods of dealing with complaints and pursuing claims can be found on the website http://polubowne.uokik.gov.pl .
  4. The consumer may also use the ODR platform, which is available at http://ec.europa.eu/consumers/odr . The platform is used to resolve disputes between consumers and entrepreneurs seeking out-of-court resolution of a dispute regarding contractual obligations arising from an online sales contract or contract for the provision of services.

11. Final provisions

  1. The Seller is entitled at any time to unilaterally introduce changes or additions to these Regulations, about which the User will be informed by e-mail.
  2. The terms of cooperation are specified exclusively in the Regulations. Any information or advertising materials regarding cooperation are for informational purposes only and are not legally binding.
